1. ACCEPTANCE OF TERMS

By using the AG102 Exercise Library Platform, you ("User," "you," or "your") enter into a legally binding agreement with GL Rehabilitation Services and Aging Gracefully ("we," "us," "our," or the "Company"). This Agreement governs your access to and use of all content, features, and services available through the Platform.
1.2 Capacity to Agree
By using this Platform, you represent and warrant that:
- You are at least 18 years of age, or you are using this Platform with the consent and supervision of a parent or legal guardian who agrees to be bound by these terms
- You have the legal capacity to enter into this Agreement
- You are not prohibited from using this Platform under any applicable law
1.3 Continued Use
Your continued use of this Platform following the posting of any changes to this Agreement constitutes your acceptance of those changes. It is your responsibility to review this Agreement periodically.

4. NO PROFESSIONAL-CLIENT RELATIONSHIP
4.1 No Therapeutic Relationship
USE OF THIS PLATFORM DOES NOT ESTABLISH A PHYSICAL THERAPIST-PATIENT RELATIONSHIP, PERSONAL TRAINER-CLIENT RELATIONSHIP, OR ANY OTHER PROFESSIONAL-CLIENT RELATIONSHIP.
The content provided is general in nature and is not tailored to your individual circumstances, medical history, physical limitations, or specific needs.
4.2 No Individualized Assessment
While this Platform may include assessment tools and personalized features:

5. ASSUMPTION OF RISK
5.1 Voluntary Participation
Your use of this Platform and participation in any exercises, routines, or programs described herein is entirely VOLUNTARY. You freely and willingly choose to participate with full knowledge of the risks involved.
5.2 Inherent Risks of Physical Activity
YOU UNDERSTAND AND ACKNOWLEDGE THAT PHYSICAL EXERCISE AND FITNESS ACTIVITIES INVOLVE INHERENT RISKS, INCLUDING BUT NOT LIMITED TO:
- Muscle strains, sprains, and tears
- Ligament and tendon injuries
- Joint injuries and dislocations
- Bone fractures
- Back injuries, including herniated discs
- Neck injuries
- Falls and related injuries
- Cardiovascular events including heart attack, stroke, and cardiac arrest
- Respiratory distress
- Dizziness, lightheadedness, and fainting
- Dehydration and heat-related illness
- Aggravation of pre-existing conditions
- Delayed onset muscle soreness (DOMS)
- Overuse injuries
- Death, in rare and extreme circumstances
5.3 Assumption of All Risks
BY USING THIS PLATFORM AND PERFORMING ANY EXERCISES DESCRIBED HEREIN, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH SUCH ACTIVITIES, WHETHER KNOWN OR UNKNOWN, INHERENT OR OTHERWISE.

- You are responsible for exercising in a safe environment
5.4 Personal Responsibility
You accept personal responsibility for:
- Determining whether you are physically capable of performing any exercise
- Consulting with healthcare providers as needed
- Listening to your body and stopping if you experience pain
- Using appropriate equipment and exercise environment
- Warming up and cooling down appropriately
- Staying hydrated and nourished
- Getting adequate rest and recovery
6. PHYSICAL ACTIVITY RISKS
6.1 Warning Signs
STOP EXERCISING IMMEDIATELY AND SEEK MEDICAL ATTENTION IF YOU EXPERIENCE ANY OF THE FOLLOWING:
- Chest pain, pressure, or tightness
- Pain radiating to the arm, neck, jaw, or back
- Shortness of breath beyond what's normal for the activity
- Dizziness, lightheadedness, or feeling faint
- Irregular heartbeat or palpitations
- Extreme fatigue or weakness
- Nausea or vomiting during exercise
- Confusion or difficulty thinking clearly
- Sudden severe headache
- Vision changes or disturbances
- Numbness or tingling in extremities
- Significant joint or muscle pain (not normal exercise discomfort)
- Any other symptoms that concern you
6.2 Pain vs. Discomfort
You understand the difference between:
- Normal exercise discomfort: Mild muscle fatigue, slight burning sensation during exercise, and some breathlessness are typically normal
- Pain signals: Sharp, shooting, or severe pain, pain that persists after stopping exercise, or pain that worsens over time are warning signs that require you to stop and potentially seek medical evaluation
6.3 Environmental Considerations
You are responsible for ensuring your exercise environment is safe, including:
- Adequate space to perform movements
- Non-slip surfaces
- Proper ventilation and temperature
- Removal of hazards and obstacles
- Appropriate footwear and clothing
- Access to water for hydration
- Presence of another person or access to emergency services if needed
7. PRE-EXERCISE HEALTH SCREENING
7.1 Self-Assessment Requirement
Before using this Platform or beginning any exercise program, you are strongly encouraged to complete a health screening questionnaire such as the PAR-Q (Physical Activity Readiness Questionnaire) and consult with your healthcare provider about any positive responses.
7.2 Health Screening Questions
If you answer "YES" to any of the following questions, you should consult with a healthcare provider before exercising:
- Has your doctor ever said that you have a heart condition and that you should only do physical activity recommended by a doctor?
- Do you feel pain in your chest when you do physical activity?
- In the past month, have you had chest pain when you were not doing physical activity?
- Do you lose your balance because of dizziness or do you ever lose consciousness?
- Do you have a bone or joint problem that could be made worse by a change in your physical activity?
- Is your doctor currently prescribing drugs for your blood pressure or heart condition?
- Do you know of any other reason why you should not do physical activity?
7.3 Ongoing Assessment
Health status can change over time. You are responsible for:
- Reassessing your health status regularly
- Updating your healthcare provider on your exercise activities
- Modifying or stopping activities if your health status changes
8. LIMITATION OF LIABILITY
8.1 Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, MATERIALS, INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED ON THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, completeness, or reliability of content
- That the Platform will be uninterrupted, timely, secure, or error-free

8.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GL REHABILITATION SERVICES, AGING GRACEFULLY, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Damages for loss of profits, goodwill, use, data, or other intangible losses
- Personal injury, including death
- Property damage
- Emotional distress
ARISING OUT OF OR IN CONNECTION WITH:
- Your access to or use of (or inability to access or use) the Platform
- Any conduct or content of any third party on the Platform
- Any content obtained from the Platform
- Unauthorized access, use, or alteration of your transmissions or content
- Any exercises, routines, or activities performed based on content from this Platform
- Any decisions or actions you take based on information from this Platform
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
8.3 No Liability for Third-Party Actions
We are not liable for:
- Actions or omissions of your healthcare providers
- Actions or omissions of any fitness professionals you may work with
- Actions or omissions of any third parties
- Your own actions or omissions
8.4 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
8.5 Maximum Liability
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
9. INDEMNIFICATION
9.1 Your Agreement to Indemnify
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS GL REHABILITATION SERVICES, AGING GRACEFULLY, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, EXPENSES, AND FEES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM OR RELATED TO:
- Your use of the Platform
- Your violation of this Agreement
- Your violation of any rights of another party
- Your violation of any applicable laws, rules, or regulations
- Any injury or harm you suffer as a result of exercises or activities performed based on content from this Platform
- Any injury or harm suffered by third parties as a result of your use of this Platform
- Any content you submit, post, or transmit through the Platform
9.2 Cooperation in Defense
You agree to cooperate fully with us in the defense of any claim. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

11.4 Reporting Concerns

15. GOVERNING LAW
15.1 Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions.
15.2 Dispute Resolution
Any dispute arising out of or relating to this Agreement or your use of the Platform shall be resolved exclusively in the state or federal courts located in Dane County, Wisconsin.
15.3 Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE PLATFORM.
16. SEVERABILITY
16.1 Severability Clause
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
16.2 Modification of Invalid Provisions
If any provision is found to be invalid, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement shall remain in full force and effect.

18.2 Voluntary Agreement
You acknowledge that you are entering into this Agreement voluntarily and not under duress.
18.3 Opportunity to Ask Questions
You acknowledge that you have had the opportunity to ask questions about this Agreement and have either asked such questions or chosen not to.
FINAL STATEMENT
THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND GL REHABILITATION SERVICES / AGING GRACEFULLY CONCERNING YOUR USE OF THE AG102 EXERCISE LIBRARY PLATFORM.
By using this Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
